Q. When do you begin settling my debts?
A. Once you have retained our services, your creditors will be notified and we will begin the settlement process. However, we can only settle a debt once the appropriate amount of funds is available in your account. This is a case-by-case basis and we will be glad to go over your plan in detail with you.

Q. If I miss a monthly payment to will I be dropped from your program?FAQs
A. No. Simply call our customer service department and we will arrange payment over the phone. It is understandable that circumstances may arise and we will help you get back on track with your payment schedule?

Q. How do I find out the progress of my debt settlement program?
A. Our client service representatives will call you monthly to update you on important changes and or settlement offers. In addition you can call us at 1-888-939-1115 to speak with a representative. We will gladly update you on all that has gone on regarding your account.

Q. My monthly income fluctuates each month. Can I still participate in the program?

A. Yes. Our fees and payment schedule is on a client-by-client basis. We will figure an affordable and simple plan for your unique situation.

Q. Are my creditors going to continue to call me?
A. We notify your creditors of our representation and inform them that they should contact us with respect to settling your debt. Most first party creditor respect the request, but they are not obligated to and have the right to contact you regarding the debt owed. As for third party collection agencies or attorneys, they are bound to the Fair Debt Collection Practice Act (FDCPA). We have a firm understanding of the laws and will utilize our resources to reduce and stop third party calls. If you continue to get calls, call our client services department immediately and they will again contact the agency informing them of our representation and sometimes take more aggressive action such as filing a complaint with the attorney general in the state the agency operates in. In all cases, you should keep a log of all calls you get from creditors that you have entered into our program.

Q. Will my creditors continue to contact me by mail?
A. Your creditors may also attempt to correspond with you by mail. However, you will then immediately contact our client services department and report this correspondence.

Q. Will this program have a negative effect on my credit?
A. YES. Your credit score will decline due to entering this program. How much it will decline depends on your original circumstances. Most of the accounts you place into negotiation are likely to “charge off”, which will reflect negatively on your credit. However, once this charged off debt is settled, the settlement is reported to the credit bureaus. After all the debts have been settled and paid, the credit score should begin to improve since the negative items have been resolved.

Q. Why should I use Emerson & Douglas Associates, LLC to settle my debts as opposed to handling it myself?

This gives us the upper hand when dealing with collection agencies. Q. Who do I call if I have a question about the program or a problem with a creditor?
A. You can talk directly with a client services representative whenever you need to discuss a problem or concern by calling 1-888-939-1115.

Q. Do I have to include all of my creditors into the program for settlement?
A. We recommend that all of your unsecured debt is enrolled into the program. However, some circumstances may prove otherwise and we would be more than happy to discuss that with you.

Q. Can I be sued?
A. Your creditors certainly have the right to sue to recover their money. So please call us to go over your specific situation.

Q. Will fees and interest continue to accrue on my accounts?

A. We request that all creditors stop all fees and interest from accruing. In most cases your interest will continue to accrue. Based on the accounts we have settled the savings have been greater than the interest that accrued on the account.

Q. What are the tax consequences?
A. Your creditors will report cancelled/settled debts exceeding $600 to the IRS and you are required to report the same as income on your annual tax return. However, the IRS permits you to write off any “income” from canceled debts up to the amount by which you were “insolvent” at the time. You need to consult your own tax advisor for advice specific to your situation.
